California won't oppose Honda hybrid settlement

SAN DIEGO (AP) ? California's attorney general won't oppose a class-action settlement between Honda Motor Co. and owners of its hybrid cars over inflated claims of fuel efficiency.

The office of Attorney General Kamala Harris doesn't explain its reasoning in a one-sentence statement Wednesday. The statement comes just hours before a deadline for California and four other states to file objections with a San Diego court.

The states asked the judge for more time to consider after a Los Angeles woman won nearly $10,000 this month in small claims court. That's much more than the couple hundred dollars cash that the settlement is offering.

The statement doesn't address Iowa, Massachusetts, Texas and Washington. In the past, officials said the states are addressing the case together.

Sen. Ron Wyden: Trade Rules Matter

Right now, the Obama Administration and the International Trade Commission (ITC) are in the process of investigating complaints alleging that China is violating global trading rules to give their domestic solar- and wind-energy industries an advantage on the world market.

The contention is that the Chinese government--recognizing the growing global demand for renewable energy products--has been giving its solar and wind energy producers enough money to price Chinese solar panels and wind turbines less than the rest of the world's solar panels and wind turbines. Their goal is to get the world's customers to stop buying the rest of the world's products and start buying from the Chinese.

The Chinese Government has made no secret of its desire to become the world's leading producer of environmental goods and has even issued a series of economic plans laying out its strategy to "speed up the development and deployment of hydropower, wind power, solar energy and biomass energy," directing local authorities to "allocate the necessary funds to support renewable energy development."

By all accounts, the Chinese Government's strategy is working. Today, my office is issuing a report showing that in just the last five years, China rose from playing a minor role in the global market for environmental goods to become the dominant actor in the world's biggest and fastest growing markets. Among other things, the report lays to rest arguments that the U.S. solar industry isn't losing out to China, showing that in just 2011, the U.S. went from a $2 billion trade surplus in solar energy products to a $1.5 billion deficit.

Of course, some will undoubtedly say: "So what?" They'll argue that that the Chinese Government can do what it wants, that we shouldn't start a trade war with China and that cheap solar panels are a good thing. And others will say this is just another example of why free trade isn't good for Americans.

Let me respond:

1. So what if China is helping its domestic industries charge less for solar panels and other environmental goods? Can't the U.S. do the same?

If China is helping its domestic industries charge an artificially low price for solar panels and other environmental goods, then China is violating international trade rules that it agreed to when it became a member of the World Trade Organization. The global rules based trading system--established after World War II and the Great Depression--was designed to prevent trade wars by creating clear, enforceable standards for all of the world's participants. Its rules ensure that competition is based, not on the amount of assistance a government provides its industries, but on each industry's ability to innovate quality products and produce them efficiently.

If China--the world's second largest economy--is violating trade rules to help its industries undercut the price of solar panels and other environmental goods, it changes the competition from a race to produce better products more efficiently to a competition to cheat better. Meanwhile, the global trading system breaks down and countries that play by the rules--like the U.S -suffer.

2. But wouldn't enforcing trade laws with China start a trade war?

Trade wars aren't started by countries appealing to respected, independent trade authorities. Rather, trade wars begin when one country decides to violate international trade rules to undercut another country's industries. In trade--as in football or any other rules-based competition--we hold the rule breaker accountable, not the coach who asks the referee for a review

If the U.S. Department of Commerce finds that China isn't breaking the rules, then no action will be taken. But if China is breaking trade rules to give its industries an unfair advantage, it's important that trade rules be enforced and tariffs be applied to negate that unfair advantage. Again, doing otherwise would undermine the integrity of the rules-based trading system.

3. But won't fewer people install solar panels if we raise the cost of Chinese solar panels?

This is a short-sighted argument. Yes, while U.S. manufacturers of solar panels are closing plants and laying off workers, U.S. solar panel installers are doing well by using the low-cost Chinese solar panels. However, if China successfully puts the rest of the world's solar manufacturers out of business, the Chinese government will stop subsidizing the price of solar panels and prices will go up.

Moreover, if China successfully puts the rest of the world's solar industries out of business, the race to innovate better, more efficient and more affordable renewable energy technologies comes to a halt.

4. Isn't this just another example of why trade is bad for Americans?

No. This is an example of why unfair trade is bad for Americans. President Obama said it best during his state of the Union Address this year when he declared: "I will go anywhere in the world to open new markets for American products. And I will not stand by when our competitors don't play by the rules."

More than ninety percent of the world's customers live outside the United States. Ensuring that U.S. companies have a level playing field to compete for those customers is probably the single best way to grow U.S. businesses and create more good-paying U.S. jobs. But free trade does not mean trade free from rules and failing to enforce trade rules not only fails to ensure that level playing field, it leaves U.S. industries at the mercy of countries that break the rules.

President Obama was right to make enforcement of those trade rules a priority and his creation, today, of a Trade Enforcement Unit is a massive step in the right direction. But as my office's report shows, we need to act quickly because it doesn't take long to lose to China.

New measuring techniques can improve efficiency, safety of nanoparticles

ScienceDaily (Feb. 28, 2012) ? Using high-precision microscopy and X-ray scattering techniques, University of Oregon researchers have gained eye-opening insights into the process of applying green chemistry to nanotechnology that results in high yields, improves efficiency and dramatically reduces waste and potential negative exposure to human health or the environment.

University of Oregon chemist James E. Hutchison described his lab's recent efforts to monitor the dynamics of nanoparticles in an invited talk Feb. 28 at the American Physical Society's March Meeting (Feb. 27-March 2) in Boston, Mass. It turns out, Hutchison said, that simply reducing the amount of gold -- the material used in his research -- in the initial stages of the process used to grow nanoparticles allows for better maintenance of the particle size.

That accomplishment, he said, has important implications. The use of lower concentrations of the precursor that forms the nanoparticles virtually eliminates the ability of nanoparticles to aggregate together and thus prevents variations of sizes of the desired end product.

"What we saw while observing the production process with small-angle X-ray scattering (SAXS) was amazing," Hutchison, said in an interview before his lecture. "We realized that it is possible to reduce the concentration of gold and allow the particles to still grow, but shutdown the coalescent, or aggregation, pathway."

He also summarized his lab's use of chemically modified grids (Smart Grids) in transmission electron microscopy to study how nanoparticles are shed from common objects such as silverware and copper jewelry -- findings that were detailed in the journal ACS Nano in October. They studied the transformation of silver nanoparticles coated on Smart Grids as well as the common objects and found that all forms produce smaller silver nanoparticles that could disperse into the environment, especially in humid air, water and light -- and likely have been doing that throughout time without any known health ramifications.

"There may be many beneficial applications to nanotechnology, but they are only beneficial if the net benefits outweigh the deleterious implications for human health and the environment," said Hutchison, who holds the Lokey-Harrington Chair in Chemistry at the University of Oregon.

These new monitoring and measuring techniques, he said, are vital to help understand what modifications are possible in the processes that grow nanoparticles for a desired product. Using green chemistry, he added, can help assure both efficiency and stability of a product, which, in turn, will lower the risk of unwanted environmental or harmful human-health consequences.

"Advancing the safe implementation of nanotechnology is vital to many fields, from electronics to medicine and materials science, in general," said Kimberly Andrews Espy, vice president for research and innovation at the UO. "Professor Hutchison has been a leader in the University of Oregon's efforts to promote green chemistry in this effort, and his work continues to set examples on how best to use it."

Hutchison is co-author of "Green Nanotechnology Challenges and Opportunities," a white paper published by the American Chemical Society's Green Chemistry Institute, and the National Research Council report, "A Research Strategy for Environmental, Health, and Safety Aspects of Engineered Nanomaterials." He also was the founding director of the Safer Nanomaterials and Nanomanufacturing Initiative (SSNI) of the Oregon Nanoscience and Microtechnologies Institute (ONAMI), a state signature research center.

Unsolicited Advice is Rarely Appreciated | Business Networking | Dr ...

I recently received an unsolicited e-mail message from a man named Chris.? The message stated:

I watched the ?video for International Networking Week and? I found it personally offensive and amateurish.? I just thought you would like some feedback.? Consider that when you make your presentation on the Today Show [next week].?

OK, so I should begin by saying ? I don?t know Chris.? I?ve never met him and have never talked to him.? Why he would feel compelled to send me such a ?pleasant? communication, I can?t fathom.

However, I am thankful to Chris.? I?m thankful because his e-mail message gives me an opportunity to talk a little bit about relationship networking.

Every time you communicate with someone (especially the first time) it is a chance to construct or deconstruct a relationship. This is the first time I?ve ever heard from Chris.? I?d have to say that ?first contact? wasn?t very constructive.

I?m not sure what possesses people to send unsolicited criticism to someone they don?t know.? But it seems to be happening more and more in this digital world.? I can?t imagine that Chris would have the chutzpa to say this to someone if he were face-to-face with them.? However, the digital world is ripe with cyber critics who can say what they want and feel more removed from the situation via the internet (it?s possible that being outside striking distance may have something to do with that).

I went back and looked at the ?offending? video.? Since Chris didn?t specify what ?offended? him, I have no idea what was said that was so offensive to him.? As for ?amateurish,? well, I understand that opinions are like noses, everyone has one (that?s the G-Rated version of this saying).? Despite knowing the opinion thing, I thought I should look at the video again closely.? It was shot by a professional videographer.? It had multiple camera angles, professional lighting, and even makeup (maybe that was offensive to Chris?).? I?ve had people say that this video was a bit ?artsy? with the cutaways being a little distracting.? Some people didn?t like the switching between black & white and color.? At least those comments were specific and constructive.?? But, amateurish ? really?? I thought maybe this guy had some amazing website that would put my video to shame so I checked it out.? Ahh, rather than go to the dark side, let?s just say I wouldn?t refer him based on his website.

Here?s the bottom line:? if you want to succeed in life, make your own business better and be sparing in the way you criticize others.

I know, I know, some people just can?t help themselves.? So, if you just can?t hold back and you feel compelled to vent on some other poor unsuspecting soul, consider these four things before you press ?send? on your nasty-gram:

1. Is your criticism unsolicited?? Unsolicited advice (especially from people you don?t know ? is rarely appreciated).
2. Do you know the person to whom you?re sending the criticism?? If not, why are you really sending it (other than to get something off YOUR chest and put it onto their shoulders)?
3. Whether you know them or not ? is your intention to give ?constructive? suggestions (otherwise known as meaningful, specific, positive ideas) or just to vent?? If it?s to vent ? tell a friend who loves you instead and leave the person you don?t know alone.
4. If you send this communication ? will it help construct a relationship or deconstruct a relationship?? If it?s the latter ? remember Mom?s advice: if you don?t have anything good to say, say nothing at all!

No one has ever built a statue to a critic.? It?s easy to tell other people what they are doing wrong.? It?s hard to do the right thing yourself.

Nashville, TN ? Senior Tanesha Campbell, of the Austin Peay State University women?s indoor track and field team became an individual champion in the shot put and put the Lady Govs in second place after Day One of the Ohio Valley Conference Indoor Track and Field Championships, Friday.

Eastern Illinois leads the field with 56.5 points followed by the Lady Govs in second with 26.5 with Southeast Missouri, Tennessee State and Eastern Kentucky all tied with 26 points. Murray State (21), Jacksonville State (10) and Tennessee Tech (2) make up the rest of the field.

Campbell once again extended the APSU school record, this time to 14.67m, out-reaching the OVC championship field by almost a full meters distance. As the custom has been the season, Campbell?s scrutiny of her own routine paid off and her constant improvement in the event culminated on the medal stand.

?Tanesha really came through big for us today,? head coach Doug Molnar said. ?I had a feeling going into this that she would have a big day, being a fifth-year senior and going back to Tennessee State. She?s had some good practices and we expect her to have another big day tomorrow.?

Most importantly, Campbell secured 10 points for the Lady Govs, putting them in striking distance after the first day. She?ll have another chance to score for Austin Peay, Friday, during the weight throw.

The majority of Friday?s events were preliminary races, but also included championship heats in the 5,000-meter run and the distance medley relay, along with the high jump and long jump.

Xiamar Richards earned six points with a third-place finish the 5,000-meters. The Lady Govs distance medley relay team finished fifth to earn four points.

Lauren Lyles, meanwhile, gained 7.5 points. She tied for fifth in the high jump (3.5 pts) and finished sixth in the long jump (3 pts).

Austin Peay had four athletes qualify for championship heats, which will take place Saturday. Erika Adams will run the 55-meter dash, Candace Johnson will run the 200-meters and Chantelle Grey advanced in the 800-meter run. Lyles also qualified in the 55-meter hurdles.

?We had some good runs,? Molnar said. ?This is probably the most competitive I?ve ever seen this meet. I think the top eight finishers in the long jump had personal bests. We did a good job staying in the mix and tomorrow we?ve got to be even faster.?

"This lawsuit is about protecting religious liberty and the rights of conscience, our most basic freedoms as Americans."Texas Attorney General Greg Abbott said the government rule under the health care reform law passed in 2010 "compels people of faith to act contrary to their convictions.""The very first amendment to our Constitution was intended to protect against this sort of government intrusion into our religious convictions," Abbott said.Abbott and Bondi are Republicans.Officials from the White House and the Department of Justice had no comment on the pending litigation.However, it is not the first court challenge to the Obama administration's new mandate on contraceptive coverage.The Becket Fund for Religious Liberty has filed a series of lawsuits, arguing that even the revised polices on contraception access would constitute a violation of their clients' faith.Last week, the Justice Department urged judges to stay out of the controversy until a compromise can be worked out.At issue is whether religious institutions should be exempt from mandated employee coverage for birth control and other reproductive care.The administration announced a proposed compromise in the dispute earlier this month.Under its new plan, religiously affiliated universities and hospitals would not be forced to offer contraception coverage to their employees. Insurers will be required, however, to offer complete coverage for free to women who work at such institutions.In announcing the proposed compromise, Obama said "no woman's health should depend on who she is or where she works or how much money she makes." Well, it turns out Ubuntu now runs on multi-core Android devices and your handset can grant a full desktop experience when docked with a display and a keyboard. It's a customized version of Ubuntu that plays nice with Android, the two OS's sharing data and services while running simultaneously. So, you can still access telephony and texts from the Ubuntu environment while enjoying all the computing capabilities it has to offer, including: Ubuntu TV, virtualization tools for running Windows applications, desktop web browsers, and Ubuntu apps built for ARM. It isn't clear exactly what hardware you'll need to run Ubuntu on a handset, but Canonical has said it works on multi-core devices with HDMI and USB connections. Legal authorities said yesterday that a High Court judge in England has approved the use of Facebook to serve legal claims.

Lawyers in a commercial dispute were last week granted permission to serve a suit against a defendant via the popular social networking site.

Justice Nigel Teare permitted the unconventional method of service during a pretrial hearing into a case which pits two investment managers against a brokerage firm they accuse of overcharging them.

A former trader and an ex-broker, Fabio De Biase and Anjam Ahmad, are also alleged to have been in on the scam.

Jenni Jenkins, who represents Ahmad, said lawyers in the case had been trying to track De Biase in order to serve him with legal documents. She said that a copy of the suit was left at his last known address, but that it wasn't clear whether he was still living there.

The lawyers didn't have his email address, so they applied for permission to send him the claim through Facebook.

Jenkins, an associate with London-based law firm Memery Crystal, said the lawyers were confident that de Biase's account was still active.

"The counsel told the judge that someone from the firm had been monitoring the account and they'd seen that he's recently added two new friends, which made the judge chuckle," she said.

De Biase was given extra time to respond to the claim "to allow for the possibility that he wasn't accessing his account regularly," she added.

Ordinarily, British legal claims are served in hard copy ? either in person, by mail, or by fax ? although unconventional means are occasionally employed if the people involved are hard to pin down.

In December, a British judge made headlines for filing an injunction against London-based protesters from the Occupy movement via text message.

The Judicial Office for England and Wales confirmed yesterday that Teare had allowed lawyers to serve their claim through Facebook. A spokeswoman, speaking on condition of anonymity because she was not authorized to give her name, said it was the first time anyone had been served via the site "as far as we're aware."

Facebook did not immediately respond to an email seeking comment.

CALL and the Index to Canadian Legal Literature ? Slaw

The 2012 Conference in Toronto will mark the 50th annual meeting of the Canadian Association of Law Libraries and provide an occasion to highlight many of the accomplishments of the association and its members over the decades since its creation. One of many accomplishment worthy of note is the Index to Canadian Legal Literature for which CALL provided both the inspiration and the support required to create a Canadian publication that met international indexing standards.

The Proposal for a New Index

In December 1983, The Canadian Law Information Council and The Canadian Association of Law Libraries developed a proposal to create a vehicle for "fast, accurate and comprehensive access to Canadian law or law related periodical and monographic literature." At the time, there was a high level of dissatisfaction with the existing indexes and CLIC and CALL together sought to remedy their "deficiencies". The Proposal included a series of Access Standards that were considered to be of "prime importance" in indexing secondary legal literature ? Subject Arrangement, Access Fields, Coverage, Language, Format of Citation, Format of Publication, and Freqeuncy of Publication.

The Proposal was circulated to the commercial publishers in the spring of 1984. Meetings between the publishers and representatives of CALL (Balfour Halevy) and CLIC (Lorna Rees Potter) were held at which possible ways of collaborating were explored. Coincidentally, The Carswell Company Limited recognized that the Canadian Abridgment Index to Canadian Legal Literature was not up to the standard expected by the legal research community and was exploring ways to restructure the publication to meet the same need that the Proposal was intended to achieve. For Carswell, the CLIC/CALL Proposal was a godsend in that it offered a blueprint as to how Carswell should proceed.

The Response to the Proposal

Initially, both CLIC and CALL favoured the creation of a New Index using government funding to get it up and running. In the Proposal, content generation would be the responsibility of CLIC and CALL, while the role of the publisher would be limited to producing a hard and digital copy of the data.

This concept was not well received by the commercial publishers who questioned the viability of the Index when government funding ran out. As an alternative, Carswell proposed to work with CLIC and CALL to revamp Carswell's existing publications to achieve the same result, on a commercial basis.

There was no response to the Carswell offer. Unknown to Carswell, CLIC and CALL remained firm in the belief that their approach was best and proceeded to apply for government funding. At the same time, Carswell moved forward with its own plan to implement the Proposal using Canadian Currrent Law and the Canadian Abridgment.

Carswell Moves Forward

For Carswell, the first step was to hire credible and competent indexers. Two professional librarians were chosen ? Louis Mirando and Enid Lesser. They were exceptional choices. To Louis fell the task of compiling the master list subject headings and cross references that were to be used in the publication while Enid focussed on indexing. Their backgrounds and obvious competence gave the project instant credibility.

The key features of the Index they produced closely followed the blueprint contained in the CLIC/CALL Proposal:

Subject Arrangements ? The Index used as its subject authority the Library of Congress Subject Headings/Repertoire de vedettes matiere (Universite Laval), as modified for use in Canadian law libraries by the Canadian Subject Headings (National Library of Canada)/Repertoire de vedettes-matiere canadiennes (Bliblitheque national du Canada).

Access Fields ? Access to the entries contained in the Index were accessible by a word or phrase that describes a particular subject or the last name of a person, the name of the author, a book review, a case name, and a statute name.

Coverage ? The coverage of the Index included all published Canadian books, articles, and sound recordings on law or law related subjects, government documents, case comments and annotations that are capable of being systematically gathered and indexed.

Language ? The Index was a bilingual publication. French language entries appeared under French language headings and English language headings in alphabetical order, while cross references linked the terms used in one language to the terms used in the other language.

Format of Citation ? Wherever possible, the official or generally accepted citation was used. Information provided in the body of the citation, used in conjunction with the Table of Periodical Abbreviations, was complete enough to permit the retrieval of all of the items contained in the Index.

Format of Publication ? The Index was published in two formats ? as part of the Canadian Abridgment Research System and as a separate Library Edition ? with frequent updates through Canadian Current Law. Plans were developed to make the database available on a nationally available carrier and by means of microfilm. The value of proceeding this way was clear in that it immediately made the publication widely available and put the Index on a strong commercial footing from the date of publication.

Frequency of Publication ? In both formats, the Index appeared quarterly. Commencing with the 1985, the Index was cumulated annually. In addition, all items were indexed twice a month in Canadian Current Law, where each book, article, government document, case comment and annotation was listed under its Library of Congress heading.

Two Indexes or Just One

On May 21, 1986, the Index to Canadian Legal Literature was officially relaunched by Carswell. At the same time, CLIC and CALL were preparing to announce at the annual meeting of CLIC that government funding had been obtained for the creation of a New Index.

What would happen next? Carswell had a product in the market that would be duplicated if CLIC and CALL decided to proceed with a New Index? It was clear that there was no longer a need for the New Index. The only real difference between the revamped Index to Canadian Legal Literature and the New Index proposed by CLIC/CALL was the use of existing commercial publications as the vehicle for achieving the desired result.

It was a tense moment in Carswell's relationship with CLIC and CALL. Much effort had been put in developing the Proposal and in obtaining funding for a New Index. To resolve the matter, Carswell made the first move by inviting CLIC and CALL to appoint an advisory users group to assist in making policy decisions with regard to the Index. In its invitation, Carswell suggested that CLIC and CALL recognize that their objective had been achieved ? "fast, accurate and comprehensive access to Canadian law or law related periodical and monographic literature" ? and that CLIC and CALL could help make the Index even better.

Lois Dyer, the Executive Director of CLIC, responded by offering to broker an agreement between Carswell and CALL that would provide for the creation of a CALL appointed Editorial Advisory Board and ensure access to the Index through Quicklaw. In addition, CALL agreed to build a network of research librarians that would provide access to local materials that might otherwise be overlooked in compiling the Index.

CALL at 50

The role CALL played in the creation of the Index to Canadian Legal Literature was a turning point in the history of legal publishing in Canada. CALL had become a key player in determining how legal information would be delivered in Canada. CALL not only provided the inspiration and the blueprint for a commercial legal publisher to create a publication that met user needs and international standards, CALL also created an Editorial Advisory Board that served as the prototype that was subsequently used for all of the components of the Canadian Abridgment.

LANGUAGE
While it would be preferable to have all of the information available in both official languages, financial considerations preclude this possibility. At the very least, all subject headings should be bilingual with a list of cross references in both languages available in each issue. Citation would be in the language of the publication.

FORMAT OF CITATION/SUBJECT ARRANGEMENT
Use of Library of Congress Subject Headings as modified for use in Canadian law libraries. Information in the body of the citation should be complete enough to be able to retrieve the item. Standard monograph or periodical indexing bibliographic citation will suffice.

FREQUENCY OF PUBLICATION
The publication or database should be reasonably frequently updated and cumulated. If in machine readable form, use of continuous cumulation should be available through a computer database on a national carrier.
Monthly paper copy with quarterly ad annual cumulations should be available.
A microfilm copy should also be available.
In order to meet the demand for speedy retrieval, information should be available through the computer databse no more than one month from te publication date of the material being indexed. This would be regarded as the absolute outer limit of acceptable service.
Given the currency of the computerized database, publication of the monthly paper copy should not face inordinate delay in transmitting the index to subscribers. The vagaries of the Canadian postal system and printing notwithstanding, 1 1/2 months would be regarded as the outer acceptable limit of publication.
Microfilm could either be available with he annual cumulation or, if enough subscribers could be found to make it financially possible, with each monthly paper copy.

PRICE
The publication should be within the price range of the present indexes.
